For content marketers reaching Europe, AI disclosure is moving from ethical best practice to legal obligation.

This week, my students presented their situational analyses for our campaigns client, and every group included an AI Disclosure and Transparency slide: which platforms, which models, which tasks. I've always taught this as a best practice, the habit I hoped they'd carry into their careers. As of August 2, it's the law for anyone reaching EU audiences.

🎯 The Big Story
Code of Practice on Transparency of AI-Generated Content (European Commission)
The European Commission published the final Code of Practice on Transparency of AI-Generated Content on June 10, and the Commission and AI Board have confirmed it as an adequate voluntary tool for demonstrating compliance with Article 50 of the AI Act. Article 50 is the transparency piece of the law. It requires providers to mark AI outputs in a machine-readable format and requires deployers to label deepfakes and certain AI-generated text. Those obligations become enforceable on August 2, 2026.
The era of optional AI disclosure is coming to an end. The EU is leading the charge in protecting its consumers from AI deepfakes and rogue chatbots, and this lands directly in your content marketing workflow. That's the ceiling on fines for non-compliance with Article 50, or 3% of total worldwide annual turnover, whichever is HIGHER (with a proportionate cap for SMEs). This is GDPR-style enforcement architecture, and we all remember how that rollout went. Disclosure just moved from your ethics column to your risk column, and the practitioners who've been showing their work all along are the ones sleeping fine.
🏆 My Take: What This Means for Your Marketing
I've been landing this take for months: trust is the dividing line in AI-powered marketing. The practitioners who disclose their AI use and keep a real human review process haven't just been building credibility. They've been building their legal exemption.
This week's one move: Document your human review process in writing. Who reviews, what they check, who signs off. The exemption for AI-assisted text is only as strong as your ability to demonstrate it.
